Sentencing options for juvenile crime

Juvenile crimes in New York are defined as those committed by someone between the ages of 7 and 16. Punishments for juvenile crime depend on whether the crime was a felony or misdemeanor. Sentencing for a misdemeanor, not including traffic violations, may impose imprisonment for a term between 15 days and one year. Sentencing for a felony could impose imprisonment for more than a year.

Juvenile court procedures differ from the adult court system

In New York, family court governs juvenile crimes, both felonies and misdemeanors. Prior to a court date, the police prepare a juvenile report and generate an arrest number. The case then moves to the Department of Probation, which interviews the juvenile, parents or guardians and the person who made the complaint.

Depending on the type of crime alleged, adjustment services may become involved. These services can include school monitoring, probation officer appointments, community service, restitution and letters of apology. The court may also direct that the juvenile be placed in a juvenile detention facility and/or undergo treatment.
