Individuals Charged with Traffic Violations, Misdemeanors and Felonies will Benefit from Legal Representation

Let legal experience minimize your risks

The Law Office of Gordon B. Fine defends individuals charged with traffic violations in the communities of Yorktown Heights, White Plains, Peekskill, Carmel and the surrounding communities. As a Town Prosecutor, Gordon Fine knows what it takes to wage a successful defense battle. As a criminal defense attorney, he applies that knowledge and more than 25 years experience to vigorously represent traffic violation clients.

Traffic violations consist of moving violations and criminal violations. Moving violations include:

  • Speeding
  • Failure to stop for a school bus
  • Failure to yield the right of way
  • Failure to obey a traffic control signal, stop or yield sign
  • Improper passing
  • Tailgating
  • Driving left of center or in the wrong direction
  • Leaving the scene of an accident
  • Railway crossing violation
  • Child safety restraint violation
  • Cell phone use

If convicted of any of these, you receive points against your license, which may cause your insurance premium to increase. Ignoring a ticket and failing to pay a fine result in suspension of your driver’s license. If you receive three speeding convictions within an 18-month period, you will lose your license. You will also lose your license if you receive 11 points.

Penalties for common infractions include:

Speeding 1 to 10 mph over the limit 3 points
Speeding 11 to 20 mph over the limit 4 points
Speeding 21 to 30 mph over the limit 6 points
Speeding 31 to 40 mph over the limit 8 points
Speeding more than 40 mph over the limit 11 points
Reckless driving 5 points
Failing to stop for a school bus 5 points
Following too closely (tailgating) 4 points
Failing to yield right of way 3 points
Violation involving traffic signal, stop sign or yield sign 3 points
Improper passing/unsafe lane change 3 points
Leaving the scene of an accident with property damage or injury to an animal 3 points
Safety restraint (person under 16) 3 points
Driving on shoulder 2 points
Obstructing intersection 2 points
Disobeying a traffic control device 2 points

Defensive driver course

You may reduce four points on your license by taking a defensive driving course. That is a six-hour course, given in various locations, as well as on-line. It will not only reduce your points; it will reduce your insurance premium. If you have received a ticket that may result in points being placed on your license, do not take the six-hour course until after the points are actually placed on your record. Taking the course ahead of time will not reduce the points from that offense.
